Missing Airbag Sensor Results In Confidential Wrongful Death Settlement

General Motors Corporation confidentially settled an defective airbag case involving a 2002 Buick Century. The plaintiff had been driving the 2002 Century when it was rear ended by another vehicle. The black box download showed the driver was buckled and traveling 27 mph at impact. Normally this would not have reulted in extrme injuries. In thus case, the airbag did not deploy in the collision. The driver’s neck snapped and he died after three weeks in the hospital. The Century had pro-drilled holes for a frontal sensor, but no sensor was added even though its sister cars of the same year were equipped with a frontal sensor. GM argued that frontal sensors are only effective with pole impacts and that airbags do not prevent neck injuries. Volvo Trucks settles for a significant undisclosed amount

Seatbelt Failure Lawsuit

During a 2006 truck accident on I 71 in Fayette County, Ohio, our client sustained significant injuries resulting in T-12 paralysis due to the faulty design of the Komfort Latch seatbelt she was wearing. The seatbelts in the truck were designed to let the driver and passenger set the amounts of slack themselves. Our client could put as much slack in the belt as she wanted and the cab contained no guidelines or warnings about how much slack she needed to keep her safe. As a result, her seatbelt was set too loose when the truck was forced off the Interstate by another car, veering into the median and rolling to a stop on nearby railroad tracks. This was not a catastrophic accident, and her husband who was driving only suffered minor injuries. However, because of the unsafe design of her seatbelt, The client was not held in her seat properly and suffered severe spinal injuries which paralyzed her from the waist down. She now faces staggering medical bills for the rest of her life and will never live the same way again. She hired The Bodiford Law Group to represent her, and attorney Raymond Bodiford filed suit against Volvo Trucks, arguing that the Komfort Latch belt destroys the effectiveness of seatbelts.  We reached a confidential settlement before trial.

Traffic Accidents and Construction Zones

Construction companies don’t always mark construction zones in a manner that is clear to passing traffic, some of it traveling at highway speeds. As a result, sudden dips in the road, turns, or uneven pavement can cause hazards that lead to car or truck accidents. Likewise, failure to effectively control traffic means backhoes, dump trucks, and cement mixers can suddenly intrude into traffic, causing accidents. An experienced Car Accident lawyer will investigate the cause of highway construction accidents and hold negligent road construction companies or governing authorities liable for poor planning and traffic control.

In cases involving defective road designs or negligent highway maintenance, an experienced attorney will consult experts like surveyors, civil engineers and accident investigators. They will analyze how certain road conditions contributed to or where the ultimate case of an accident, explaining what could and should have been done to prevent it from happening. In cases involving dangerous intersections along country roads, there is a review of traffic studies to see if authorities were aware of a high incidence of accidents at that location. .

Florida Chinese Drywall Settlement – Florida Homeowners to share $55 million

Pending approval by a Federal Judge in New Orleans, a settlement has been reached between the importer of tainted drywall and hundreds of Florida Homeowners.  Drywall is used to construct walls and ceilings in most modern homes and commercial buildings. Starting in 2006 the tainted product has been blamed for emitting a horrible stench and for producing fumes that can damage air conditioning, electrical wiring and other home fixtures.

The settlement will be funded by Banner Supply Co, its affiliates and their insurers, which agreed to set aside the money under a preliminary settlement. A spokeswoman for the plaintiffs’ attorney said the deal covers between 500 and 800 homes which were supplied with drywall by Banner.

Additionally, there was information in the court record that the manufacturer lied about safety issues with the tainted drywall…. read more at reuters.
